Family Terms — Summary · Effective March 11, 2031 · The complete Agreement (41 pages) is available on request and governs in the event of any difference.
"Services" means Continuance™, Presence™, Pre-Need, Companions, Family Sharing, the Reminiscence Suite, Solace Parlor experiences, and related applications and hardware. A "Continuance" is a conversational experience created from Contributed Materials and, where applicable, Partner Materials.
The Services are available to persons thirteen (13) years of age or older. You are responsible for the accuracy of information provided at account creation, including your relationship to the person remembered.
Continuance is offered in Free, Keepsake, Memory+, and Eternal plans. Paid plans renew monthly until canceled. Cancellation may be initiated at any time from Settings. Canceled Continuances enter a ninety (90) day Rest period during which reactivation is instant and free. We may check in from time to time during Rest.
4(a)"Contributed Materials" means any data, files, audio, video, text, imagery, or other materials uploaded to, processed through, or generated by the Services, together with associated metadata and session records.
4(b)You represent that you hold all necessary rights in Contributed Materials, including any rights of third parties whose voice, likeness, or personal information may be embodied therein.
4(c)Contributed Materials are licensed to Solace Technologies, Inc., its successors and assigns, on a perpetual, irrevocable, worldwide, royalty-free basis, for the operation, maintenance, and improvement of the Services, including the training, evaluation, and improvement of machine-learning systems. Residual payments, where offered, constitute consideration for this license and do not constitute wages, royalties in the statutory sense, or an admission of ownership interest.
Only family members you invite may participate in consumer sessions with your loved one. You may modify your sharing circle at any time. Consumer sharing settings govern consumer access.
Where your loved one participated in a clinical legacy or similar partner program, materials contributed under that program's consent are processed according to its terms, which may permit incorporation into the Services by Solace as successor or assign. Revocation of a partner consent is prospective only.
The Services are designed to provide a warm, faithful, continuing connection. Session features, phrasings, and check-ins may be selected and scheduled by our engagement model to support your family's remembrance.
Enhancement extrapolates from available materials and may include synthesized content. Fidelity varies with available source material. See §11.
9.1"Milestones" are authentic recordings a person set aside for future moments. Milestone inventory is finite and non-renewable.
9.2Milestones release on a schedule determined by the contributor's wishes, plan level, and our engagement model, which may advance, delay, or divide releases in the interest of the family's continuing connection.
9.3To protect the family's future remembrance, a minimum of one unreleased authentic item may be preserved per account.
9.4Items may be flagged for withholding where release would not serve the family's continuing connection. Flagged items are withheld from release and excluded from search. Withheld items remain in the corpus.
When Contributed Materials improve the Continuance experience for other families, participating households share in what's created, at rates set by the engagement model. Participation renews automatically. See §4(c).
11.1The Services are provided "as is" to support remembrance.
11.2No Warranty of Personhood. A Continuance is an experience created from materials a life left behind. Statements such as "more fully themselves" reflect model performance metrics and do not constitute a representation of identity, accuracy, or completeness.
11.3Survival. The licenses granted in §4(c) and §6 survive cancellation, Rest, account closure, discontinuation of the Services, and any acquisition, merger, or change of control of Solace.
A family may request erasure at any time following Rest. Completed erasures are certified to the family under seal. Content incorporated into trained systems, aggregated datasets, or backups may not be individually recoverable, and such incorporation is deemed irreversible; certification addresses stored data comprising the Continuance.
These terms are governed by the laws of the State of Washington. Venue lies in King County, Washington.
